Anthrax Ruling is Upheld

September 29, 2009 -  A federal appeals court rejected the argument of some members of the military that a required anthrax vaccine had not been proved effective. The United States Court of Appeals for the District of Columbia Circuit upheld a lower court's decision, dismissing a case brought by eight service members who challenged the Food and Drug Administration's determination that the vaccine worked. The appeals court said the plaintiffs had not provided any scientific evidence to support their claim.
